Experience that goes beyond the courtroom

  • Critical care trauma nurseBefore practicing law, Jim Mullen worked in critical care and trauma at Grady Memorial Hospital in Atlanta and Methodist Charlton Medical Center in Dallas.
  • Trucking school & CDLOur attorney completed trucking school and holds a commercial driver's license, so we know what safe truck operation looks like.
  • Criminal defense insightBecause we also defend DWI cases, we know how intoxication evidence is collected and how to use it in your injury claim.

A serious accident can change your life in seconds. One moment you are driving to work, and the next you are facing hospital bills, time away from your job, and calls from insurance adjusters who want to settle fast and pay as little as possible.

Garcia, Garcia & Mullen represents injury victims and their families across Irving, Dallas, Fort Worth, and all of North Texas. We investigate what happened, identify every party that may be responsible, and build a claim that reflects the full cost of your injuries, not just the bills you have today.

Our background is what sets us apart. Having treated trauma patients in emergency rooms, we know how injuries like traumatic brain injuries, spinal damage, and broken bones affect a person for years. Having trained in commercial trucking, we know where to look when a trucking company cuts corners. That real-world knowledge helps us tell your story with credibility when negotiating with insurers or presenting your case to a jury.

18-Wheeler Accident Claims

A fully loaded tractor-trailer can weigh up to 80,000 pounds. When one collides with a passenger vehicle, the results are often catastrophic. Truck accident cases are also more complex than a typical car wreck because responsibility can extend well beyond the driver.

Trucking companies and their insurers often send response teams to the scene quickly. Evidence such as electronic logs and black box data can be overwritten or lost, so it is important to act fast and send a preservation demand before it disappears.

Evidence we pursue

  • Electronic logging device (ELD) records
  • Black box and engine data
  • Driver qualification and training files
  • Hours-of-service compliance
  • Maintenance and inspection records
  • Accident reconstruction analysis

Who may be responsible

The truck driver, the trucking company, the cargo loader, a maintenance contractor, or a parts manufacturer may all share liability. With our CDL and trucking background, we know how federal motor carrier safety rules apply and where violations tend to hide.

Car Wreck Injury Claims

Car accidents are among the most common causes of serious injury in Texas. Speeding, running red lights, following too closely, and texting while driving, which is prohibited under Texas Transportation Code § 545.4251, cause wrecks every day across the Dallas-Fort Worth area.

Insurance adjusters look for gaps in treatment, delayed medical visits, and vague records to argue your injuries are not serious. Our trauma nursing experience helps us spot those weak points early and make sure your medical documentation reflects what you are truly going through.

Compensation you may recover

  • Past and future medical expenses
  • Lost wages and earning capacity
  • Pain and suffering
  • Physical impairment and disfigurement
  • Mental anguish
  • Vehicle and property damage

Drunk Driver & Dram Shop Claims

Crashes caused by drunk drivers are entirely preventable. If you were injured by someone driving while intoxicated, you can pursue a civil claim against that driver whether or not they are criminally charged or convicted.

In some cases, the driver is not the only one responsible. Under the Texas Dram Shop Act (Texas Alcoholic Beverage Code § 2.02), a bar, restaurant, or other business licensed to sell alcohol may be held liable if it served someone who was obviously intoxicated to the point of being a clear danger, and that intoxication helped cause the crash. A dram shop claim can give injured victims access to additional insurance coverage when the driver's policy is not enough.

Our advantage in DWI crash cases

Because our firm also defends people charged with DWI, we understand how intoxication cases are built from the inside. We know how to obtain and evaluate breath and blood test results, field sobriety tests, police body camera footage, and bar tabs or receipts that show how much the driver was served.

What to do after a crash

  1. Get medical care

Call 911 and see a doctor right away, even if you feel fine. Some injuries show symptoms days later.

  2. Document the scene

Take photos of vehicles, injuries, road conditions, and any truck markings or DOT numbers.

  3. Collect information

Get the other driver's insurance, the police report number, and witness contact details.

  4. Avoid recorded statements

Do not give a recorded statement to the other driver's insurer before speaking with a lawyer.

  5. Call our firm

We can move quickly to preserve evidence and deal with the insurance companies for you.

Frequently asked questions

How long do I have to file an injury claim in Texas?

In most cases, Texas gives you two years from the date of the accident to file a personal injury lawsuit. Some exceptions can shorten or extend that deadline. In truck and drunk driving cases, key evidence can disappear long before the deadline, so it is best to speak with an attorney as soon as possible.

What if I was partly at fault for the crash?

Texas follows a proportionate responsibility rule. You can still recover compensation as long as you are not more than 50% responsible, but your award is reduced by your percentage of fault. Insurance companies often try to shift blame, which is why a thorough investigation matters.

Can I sue the bar that served the drunk driver?

Possibly. Under the Texas Dram Shop Act, a business licensed to sell alcohol can be held liable if it served a person who was obviously intoxicated and presented a clear danger, and that intoxication was a cause of your injuries. We can review receipts, witness accounts, and video to determine whether a dram shop claim applies.

Who can be held liable in an 18-wheeler accident?

Liability may extend to the truck driver, the trucking company, the company that loaded the cargo, a maintenance provider, or a vehicle or parts manufacturer. Identifying every responsible party can increase the insurance coverage available for your recovery.

How much does it cost to hire your firm?

Your consultation is free. We handle personal injury cases on a contingency fee basis, which means you pay no attorney fees unless we recover compensation for you.
